Know Your Rights: Undocumented Immigrants and ICE Encounters
All individuals in the U.S., including undocumented immigrants, have constitutional rights. If immigration (ICE) agents come to your door:
You do not have to open the door unless ICE presents a valid search warrant signed by a judge.
A deportation warrant is not enough.
Ask to see the warrant under the door or through a window.
If the warrant lacks your name/address or a judge’s signature, you are not required to let them in.
You have the right to remain silent.
You do not have to answer questions about your immigration status or where you were born.
Say: “I choose to remain silent.”
You may use a “know-your-rights” card to assert this.
You have the right to an attorney.
You may ask to call a lawyer if detained.
If you have a lawyer, provide a signed Form G-28.
If not, ask for a list of free (pro bono) attorneys or contact your consulate.
Do not show false documents or lie.
You may refuse to show ID revealing your country of origin.
You do not have to sign anything before speaking to a lawyer.
If you choose to sign, be sure you fully understand the document.
You may request to call family or friends for free if you don’t have funds within 10 days of detention.
